Correspondence by Royal Mail

Planning officers will provide advice relating to whether planning permission is required for a particular development or use. Such enquires should be made in writing, accompanied by a drawing of the development. If you require formal confirmation from the Planning Authority that planning permission is not required you can apply for a Certificate of Lawfulness.

Pre-Planning Application Advice

Applicants are strongly encouraged to liaise with the Planning Service before submitting a planning application.

From the 1 July 2017, the Planning Service is introducing a protocol for managing the process of pre-application enquires with the primary objectives of ensuring that all proposals for development are of a high quality, are directed by the policies and proposals in the Aberdeen Local Development Plan and are progressed and determined in the most efficient manner. This is a non-statutory service and is available to anyone wishing to carry out development in Aberdeen.

Whilst the use of this protocol is encouraged, it will be discretionary rather than mandatory for all non-householder pre-application enquires.

Whether pre-application advice is beneficial will depend on the nature and scope of the proposal. This protocol is not intended for enquires relating to householder development (i.e. extensions and external alterations to dwellings and flats, and domestic development within the curtilage of dwellings and flats).

If you are uncertain whether your proposal warrants the use of this service or the proposal relates to householder development, we recommend contacting the Application Support Team on 03000 200292 or email

Please be aware that the pre-application advice service is not for the purposes of establishing if a development requires planning permission. If you require formal confirmation whether a development or use requires planning permission you should apply for a Certificate of Lawfulness.

Legal Agreements Templates

The Council's Legal and Planning teams have put in place standard templates for legal agreements associated with planning permission and planning permission in principle under Section 75 of the Town and Country Planning (Scotland) Act 1997 (as amended). It is expected that this will improve the consistency, certainty and speed of finalisation of legal agreements and, thereby, the efficiency and effectiveness of the planning process.

Please note that as of 16 January 2017 the templates will form the basis for the drafting of all new Section 75 legal agreements. Legal agreements that are already been agreed in draft form will not have to be changed. The templates are available to view at the following links:
