The Scottish Courts and Tribunal Service (Transport Appeals) state that appeals should be responded to within 56 days. We will usually respond sooner than that but if you have not received any response after 56 days please let us know.

What happens next

When we receive your appeal we will:

  • Put the LEZ PCN that you are appealing on hold and take no further action while we consider your appeal. Only the LEZ PCN that you are appealing will be put on hold. We will continue to take action against you for other LEZ PCNs that have been issued to you if you have not paid these or have not submitted a separate appeal.
  • Carefully consider your appeal, taking into account any evidence that you submit, relevant road traffic regulations, traffic orders or Council policy that relate to the contravention

We will usually contact you by email to let you know the outcome of your appeal. Please check your junk / spam folder or add noreply@aberdeencity.gov.uk and donotreply@aberdeencity.gov.uk  to your approved email address list.

If we do not have your email address, we will write to you at the address that you have provided, or to the registered keeper of the vehicle if we do not have your address.

If you appeal against the LEZ PCN, do not make any payment until we have let you know the outcome of the appeal. If you pay the charge while the appeal is ongoing, we will close your case.

Reasons for appeal

The table below summarises the grounds that you can use to appeal:

  • Any relevant details or documents, e.g.  copy of your V5C or other evidence to show that your vehicle meets the required emissions standards.
I did not own the vehicle when contravention happened.
  • The name and address of the person who bought or sold the car.
  • The date of the sale or purchase.
  • Receipt for the sale or purchase.
  • Copy of the letter of acceptance issued by the DVLA on receipt of the V5C Vehicle  Registration Document.
The penalty charge exceeds the relevant amount.
  • Any relevant details or documents.
The vehicle was on hire and the hirer signed a formal agreement accepting liability for PCNs.
  • The name and address of the hirer.
  • A copy of the agreement they signed.
I am a vehicle trader and was not the registered keeper at the time of the contravention.
  • The name and address of the person who bought or sold the car.
  • The date of the sale or purchase.
  • Receipt for the sale or purchase.
  • Copy of the letter of acceptance issued by the DVLA on receipt of the V5C Vehicle  Registration Document.
Although the contravention happened, there are extenuating circumstances and it is unreasonable to impose an LEZ PCN.

We do not usually accept appeals under any other circumstance. If you are appealing for another reason, please provide as much relevant information as you can and provide any relevant documents.

If we need more evidence from you in order to make a decision we will ask for this.

If your appeal is accepted

If your appeal is accepted the LEZ PCN will be withdrawn and you will not have to pay the charge. We will contact you to let you know this.

If your appeal is rejected

If we reject your appeal, we will send you an official Notice of Rejection. This will explain:

  • The reasons for our decision.
  • How to pay the LEZ PCN
  • What you can do if you are still unhappy with our decision.

If you do not take any action once a Notice of Rejection has been issued, we will issue a Charge Certificate after 28 days.

If you are unhappy with our decision, you can appeal to The Scottish Courts and Tribunals Service. They are an independent panel of adjudicators who will consider your case.

You can only submit an appeal to The Scottish Courts and Tribunals Service if we have issued a Notice of Rejection. The Notice of Rejection will tell you how you can submit an appeal to the tribunal.

If you have received a Charge Certificate

Once you have been issued with a Charge Certificate, you no longer have the right to appeal.

We may consider carrying out a review of your case at this stage but only in very exceptional circumstances. If you would like us to do this, please use our online portal to submit an appeal or write to us at:
