Virtual Parking Permit Terms and Conditions

By applying for a permit, the applicant agrees to be bound by the following terms and conditions:

1. Applying for and managing a virtual parking permit

1.1 Applicants must be 16 or over of age to apply for a permit. 

1.2 By applying for a residential parking permit, the applicant believes they meet the eligibility criteria for the permit. 

1.3 It is an offence under the Road Traffic Regulation Act 1984 for a person to knowingly make a false statement to obtain a permit for himself or another; to lend or allow to be used, with intent to deceive, a permit for use by another person; to counterfeit or forge a permit; to aid, abet, counsel, procure or incite another to commit such an offence. Aberdeen City Council may conduct such investigations as it considers necessary to prevent or detect fraud and misuse of parking permits.  

1.4 It is the responsibility of the permit holder to ensure their parking permit account details are both accurate and up to date. The holder must update their parking permit account immediately if there are any changes to the information provided when registering. The council may suspend or cancel their account and, therefore, their permit(s), with immediate effect if they breach these terms and conditions. If the council decides to take this action the applicant will not be entitled to a refund. 

1.5 It is the responsibility of the permit holder to ensure that their permit has been activated for their vehicle. Failure to do so may result in a Penalty Charge Notice (PCN) being issued on the vehicle. 

1.6 Any Penalty Charge Notice (PCN) that is issued to a vehicle because of inaccurate information being recorded by the applicant will not be eligible for cancellation. This does not affect any appeal rights.  

1.7 If the permit holder’s qualifying circumstances change at any time, such as, the ownership of the vehicle/s or their address, then the permit holder must amend their account accordingly. This can be done online via their online parking permit account. 

1.8 A permit does not guarantee a parking space will be available, nor does it assign a bay to an individual or property. 

1.9 The council reserves the right to cancel or refuse to issue a permit, and the permit holder will forfeit their fee if: 

  • the permit holder or any person using the permit fails to comply with a reasonable request from a City Warden, a police officer or an authorised officer of the council in respect of their behaviour or usage of any permit issued by the council it becomes apparent that a permit issued by the council is improperly held or is being improperly used; 
  • it becomes apparent that you are not eligible for the permit type that you hold or that it is not being use appropriately;
  • there is any default in payment of the council's appropriate charge for the permit; 
  • the vehicle against which the permit has been issued has five or more outstanding penalty charges which have reached the stage where the statutory rights of appeal have been exhausted.  
  • the council has reason to believe the permit holder has moved away from the registered permit address. 

1.10 Aberdeen City Council provides a privacy notice on its website which details how the council uses personal data when applying for a permit.

1.11 The council can cancel a permit where it considers the Terms and Conditions have not been met.

2. Renewals

2.1 Permits do not automatically renew, it is the permit holder’s responsibility to ensure they renew their permit in time. 

2.2 Permits can be renewed online 30 days before the expiry date. 

2.3 If a permit is renewed prior to the expiry date then any new permit term will be added on to the original date of expiry.  

2.4 If a permit has expired the customer will have an additional 10 days to renew the permit online. The permit will not be valid for use between the expiry date and the date it is renewed. This means that the appropriate parking charges must be paid during the period that the permit is not valid. The permit will become valid again once it has been renewed and the fee for the permit paid. The date payment is taken will be the date the permit is valid from and any purchased term will also start on that date. 

2.5 If a permit has expired for more than 10 days then it is no longer possible to renew the permit and a new application will need to be made. 

2.6 Any PCN issued while the permit is not valid will not be eligible for cancellation. Renewing the permit after receiving a PCN will also not make the PCN eligible for cancellation. This does not affect the right to appeal a PCN. 

3. Cancellations and refunds 

3.1 Only resident and business permits can be cancelled and issued a refund. 

3.2 Minimum term period apply to each permit type, only unused months beyond the minimum term are eligible for refund and subject to an additional £10 administration charge.

3.3 When cancelling online you will be provided an estimate of the refund due, the council reserve the right to amend this figure based on any mitigating factors. 

3.4 Permit cancellations and refund requests cannot be back dated, it is the permit holder’s responsibility to ensure they submit the cancellation request. 

3.5 If the council cancels a permit for any reason, there is no entitlement to a refund. 

3.6 All refunds will be processed within 10 working days of cancellation. 

3.7 Refunds will only be issued to the original payment method used to purchase a permit. 

4. Terms of use

4.1.1 Aberdeen City Council will carry out checks to ensure that the applicant is entitled to receive a residential parking permit. These checks can be carried out via a soft credit search to confirm the applicant’s information provided is accurate and they reside at the address where a permit has been applied for. This allows for an immediate automated decision to be taken on an application. If the applicant does not pass the automated check they will be asked to upload documentation to demonstrate their eligibility for a permit.

PLEASE NOTE: A soft credit check doesn't leave a visible footprint on your credit file, but it is recorded. This means no lenders can see the search made when applying for a permit with Aberdeen City Council and a soft credit check will not impact your credit score. 

4.1.2 If the permit holder moves property they must cancel all their permits by the date they move from their registered property. If the permit holder moves to another zone, they must still cancel all their permits on the date they move from their registered property and apply for a new set of permits at their new address. Please refer to the cancellation and refunds section of these terms and conditions.

4.1.3 When applying for a fixed resident permit you must be the registered keeper of a vehicle and that vehicle must be registered with the DVLA at the address stated in your application, except if: 

  • you use a vehicle belonging to your employer; you must upload a confirmation letter on company headed stationery stating that you are entitled to use the vehicle. 
  • you have hired/ leased a vehicle and require a parking permit for that vehicle; you will need to provide the hire / lease agreement. The hire / lease documentation must show your name and address.  

4.1.4 Resident permits are only permitted to be used within the Controlled Parking Zone (CPZ) that your residential property is associated with . 

4.1.5 Resident permits are only valid when used within the marked street bays in the designated CPZ. They do not exempt parking on other restrictions such as ‘yellow line’ prohibition of waiting restrictions, bus stops etc.

4.1.6 Permits are not valid for use in parking bays that have been suspended due to a Temporary Traffic Order; these types of order are used for road maintenance, utility works, special events etc and when in operation will clearly be specified by appropriate signs, cones etc that are placed on the road. 

4.1.7 Resident permits can only be used on a passenger vehicle (designed for 8 passengers or less, excluding the driver) or light goods vehicle that weighs less than 3.5 tonnes and designed for 8 passengers or less (excluding the driver)  

4.1.8 A Fixed parking permit is assigned to only the applicants DVLA registered vehicle or hire car and is not valid for use on any other vehicles. 

4.1.9 A Flexible parking permit can be used on any vehicle that meets the conditions set out above.
 

4.2.1 You are entitled to a business permit if your business premises are in a controlled parking zone and the permit is used solely for business purposes. 

4.2.2 Your business must also be registered as paying Non Domestic Rates to Aberdeen City Council. 

4.2.3 Business permits are for vehicles insured for business purposes, they should not be used for commuting to and from your place of work.

4.2.4 Business permits will not be issued for trailers or caravans. 

4.2.5 Business permits are not valid in 45 minute parking bays, for parking on single or double yellow lines or in places with any other type of parking restrictions e.g. loading only bays 

4.3.1 You are only entitled to a contractor parking permit if you use a vehicle when engaged in an eligible trade and it would be unreasonable to expect the work  to be conducted without the vehicle being directly outside the property/site at which the work is being carried out.

4.3.2 Eligible trades are:

  • Aerial installation
  • Bathroom fitting
  • Building
  • Carpentry
  • Carpet fitting
  • Electrical installation and gas maintenance
  • Insulation installation
  • Joinery
  • Kitchen fitting
  • Masonry
  • Painting
  • Painting and decorating
  • Plumbing
  • Roofing
  • Tiling
  • Window fitting

4.3.3 With a contractor parking permit, you can park in any on–street pay and display, permit and voucher bays in Aberdeen City, in all zones.

4.3.4 You cannot use contractor parking permits in any 45-minute zones, on single or double yellow lines or pay and display car parks.

4.3.5 The permit is not valid in any of Aberdeen City Council's pay and display car parks.

4.3.6 The Council will not issue permits to allow convenience parking and the permit should not be used for convenience parking.
 

4.4.1 Car park permits are only available for Denburn multi-storey, Frederick Street multi-storey (levels 5 and 6 only), West North Street multi-storey and Virginia Street car park. Permits are only issued for use in one specific car park and are only valid for use in that car park.

4.4.2 No refunds will be given for car park permits.
