Fixed Penalty Notice
Aberdeen City Council is dedicated to maintaining a clean, safe, and pleasant environment for everyone. Fixed Penalty Notices are issued when we believe you have carried out a specific action in contravention of one of the following:
- Environmental Protection Act (1990) – Littering, Fly Tipping and other business offences
- Dog Fouling Act (Scotland) Act 2023 – Dog fouling
- Antisocial Behaviour etc. (Scotland) Act 2004 – Noise Control Provisions
FPN’s are issued to a business if we believe you carried out a specific action, or failed to carry out an action in contravention of one of the following:
- Environmental Protection Act (1990) - Flytipping, and failure to provide a waste transfer note
- Waste (Scotland) regulations 2011 and 2012
- Commercial waste regulations 1992
- Environmental Protection (Duty of Care) (Scotland) Regulations 2014
- The Zero Waste (Scotland) Regulations 2011.
Littering
It is an offence under Environmental Protection Act (1990) to drop throw or otherwise dispose of your litter in a public place and not picking it up.
Dog Fouling
It is an offence under the Dog Fouling (Scotland) Act for a person in charge of a dog to fail to remove and dispose of appropriately any excrement after the animal has fouled. The Act applies to all public places including common passages, back greens, stairs and other similar areas.
If you wish to appeal a Fixed Penalty Notice, this must be done in writing, by post or by email, to the Environmental Health service. Find out more about dog fouling.
Flytipping
Fly-tipping is the illegal dumping of waste that is not licensed or authorised to receive your waste it and can include, bin bags, commercial waste, old furniture or household goods. An FPN may have been issued to an individual or to a business.

Noise Control Notices (Residential)
A noise control offence occurs when excessive noise is made at a property and the noise recorded by our officers exceeds the permitted decibel levels as set in legislation.
FPNs must be paid within 28 days of the date of the notice. If you pay the penalty within that period no further proceedings will be taken. Failure to pay within this period may result in the matter being reported to the procurator fiscal and the penalty may be a much larger fine. A FPN is an opportunity for you to discharge liability from conviction.
Payment Information
All FPNs can be paid online these include:
- Littering: £80 and must be paid within 14 days of the date of the notice.
- Dog Fouling: £80 rising to £100 if not paid within 28 days.
- Fly Tipping: £500
- Noise Control Notices (Residential): £100
